A mio parere qui, sulla base delle posizioni iniziali delle parti (esplicitate nelle memorie introduttive) il giudice non ritiene sia necessario procedere. Quindi rigetta (o se vogliamo un termine più nostrano "archivia") il caso, fornendo una motivazione. Qui la motivazione sta nell'infondatezza dell'azione stessa, in quanto non la discriminazione non sussiste.
Nei miei glossari trovo:
prima facie case= azione provvista di fumus boni iuris
prima facie evidence= prova della fondatezza dell’azione

A mio parere qui, sulla base delle posizioni iniziali delle parti (esplicitate nelle memorie introduttive) il giudice non ritiene sia necessario procedere. Quindi rigetta (o se vogliamo un termine più nostrano "archivia") il caso, fornendo una motivazione. Qui la motivazione sta nell'infondatezza dell'azione stessa, in quanto non la discriminazione non sussiste.
