20.8.1 THE PACIFIC
Once again the reader is referred to previous modules, particularly the 1st and 4th centuries of the Christian Era. It is assumed that in the first Christian millennium there was a gradual increase in the Polynesian tribes and a continued island to island migration via double canoes, so that the more southern islands of the Marquesas, Samoa, Tahiti, etc., were reached by Hawaiian travelers sometime in this period. The large canoes are still used by Indians, Aleuts and others along the Canadian coastal waters, although currently they may add as many as three masts and sails to a thirty-five foot kayak. (Ref. 56 ([81]))

20.9.1.1 NORTH AMERICA
20.9.1.1.1 CANADA AND THE FAR NORTH

20.9.1.1.2 THE UNITED STATES
The Mississippian Culture of Mound Builders, which now replaced the decaying Hopewell Culture, flowered along the Mississippi River and other river systems of the south.
Archaeologists do not agree about its origin. Some attribute it to the migration of ideas from Mexico or Central America and it is true that some of the sophisticated art does resemble Middle American. But even more of the art seems to have had roots in Adena or Hopewell and current thinking treats the Mississippian as an indigenous culture, an outgrowth of the Hopewell blended with late arriving Mexican elements. The characteristic feature of the culture is the pyramidal mound serving as a foundation for a temple or a chief’s house. Some centers were very small but others were gigantic, as Cahokia at East St. Louis, Illinois, where there were more than 85 mounds and a village area that extended for six miles along the Ohio River. One of the largest of the mounds was about 100 feet high and its base covered 16 acres. The immensity of the labor involved, without the use of wheels or beasts of burden, is almost unbelievable. The entire enterprise may have taken several hundreds of years. The Mississippian population was dense in that at least 383 villages bordered the Mississippi River in the short distance of about 700 miles between points of entrance of the Ohio and Red rivers respectively and there were thousands of other villages up and down the other parts of the river system. (Ref. 64 ([94]))
If we are to believe Professor Fell (Ref. 66 ([97])) Libyan science and mathematics continued to flourish in the southwest. The Hohokam continued their colonizing migrations, beginning their colonial period sometime after 550, spreading artifacts over most of Arizona and taking with them their customs, including the sacred ball-game. Farther northeast the Anasazi or Pueblo Builders, continued advancement with better pottery designs and increased trade, importing abalone shells and turquoise. (Ref. 269 ([193])) From a source still unknown they obtained the bow and arrow and they developed the hafted ax. Agriculture increased with the cultivation of better corn, squash and beans, which added protein to their diet. Their population then soared and their settlements spread so that they even had pit houses in the cliffs of the Grand Canyon. (Ref. 277 ([37]))
20.9.1.2 MEXICO, CENTRAL AMERICA, AND THE CARIBBEAN
Teotihuacán in the Valley of Mexico was at the height of its power and was larger than imperial Rome, some estimating the population at 125,000 with an area of 20 square kilometers. (Ref. 8 ([14])) It was a religious and cultural capital and a major economic and political center for Middle America. Its power extended widely with intermingling of tribes and cultures, so that there was a strong Mexican presence even at Kaminaljuyu (now Guatemala City). Even the lowland Maya region, as at Tikal, had Teotihuacan artistic traditions, although Tikal was only one-fifth as large as the Mexican city.
The Maya had a number of languages, all closely related but not mutually intelligible. There were two principal divisions - the lowlands groups, including Yucatec, Chol and Chorti - and the highlands (Guatemalan) which included Mam and Quiche. The educated Maya were profoundly intellectual and we have noted their mathematics (0 to 100 A.D. (Section 15.9.1.1.3: MEXICO, CENTRAL AMERICA AND THE CARIBBEAN)) and astronomy (A.D. 301 to 400 (p. 281)) previously. A great renaissance of Mayan Culture now took place in the cities of Yucatan, gradually supplanting the importance of Peten, in the south. (Ref. 177 ([243]), 146 ([199]), 215 ([290]), 163 ([222])) According to traditions, picture writings and Mexican manuscripts written after the conquest, the Toltecs were banished from their native country northwest of Mexico in 596 and proceeded southward. (Ref. 205 ([276]))
This century marks the beginning of Period V of Costa Rican prehistory, with each of three archaeological zones developing independently. In Guanacaste-Nicoya there was the beginning of the famous Nicoya polychrome pottery tradition which resembled Maya ceramics of the Late Classic period of Honduras and El Salvador. The progress in Panama seemed to come more or less to a halt and this country never developed any truly state-centered societies as seen farther north in Central America. (Ref. 266 ([67]))
20.9.1.3 SOUTH AMERICA
20.9.1.3.1 NORTHERN AND WESTERN SOUTH AMERICA
Along various parts of the Magdalena River Valley in Colombia and particularly near San Agustin are enormous piles of debris, some of which have been excavated revealing sculptured monoliths and the whole indicating a great ceremonial center something like a Maya complex. Radio-carbon datings indicate activity in this 6th century with continuation for another 1,000 years. Since it has some similarities to both the Olmecs and to Easter Island the question arises as to whether this astonishing statuary was local in origin or from migrating people from Central America or even from Polynesia. Just east of Popayan on the eastern hot-land part of Andean Columbia is an interior, isolated valley called "Tierradentro" where there are interesting monuments perhaps dating to this same era, although it may be a secondary society having existed a thousand years later. Accurate dating has not been accomplished. Tombs there have long ago been looted, probably of gold and jewels, but three dimensional statues reminiscent of Easter Island and representing anthropomorphic gods are comparable to those of San Agustin. (Ref. 62 ([91]))
Peru consisted of about nine separate regions, each with its own local art style in this century. The Moche, or their descendants, and the Nasca were supreme but other states of some consequence were Cajamarca, Recuary, Lima, Huarpa, Waru, Tiahuanaco and Atacameno, all of which used gold, silver and copper for tools as well as jewelry. In Ecuador, beginning about A.D. 500, there were people of the Milagro Culture, noted for elaborate work in gold and for artificial mounds for burial places and home sites. Some of the latter seem to be associated with ridge systems and others with rectangular earth- works, probably made to farm lands subject to seasonal flooding. This culture may have been an off-shoot of the Moche of Peru, described in previous chapters. Similar farming ridges cover many thousands of acres in Bolivia and Colombia and are present near Lake Titicaca, although the dating of these has not been done. (Ref. 9 ([15]), 62 ([91]))
20.9.1.3.2 EASTERN SOUTH AMERICA
There were farming tribes in the Amazon rain forest, cultivating manioc. Farther south the Tuni-Guarania tribes had migrated from the Amazon basin into the Brazilian forest and savannah. In what in now Argentina, there was the Aguada Culture about A.D. 600, characterized by black and yellow pottery with feline motives. (Ref. 8 ([14]), 45 ([66]))

21.1.1 A.D. 601 TO 700
The chief features characterizing this century are the persistence of the "Dark Ages" in Europe, the amazing eruption of the Arab armies and the Moslem religion out of the desert of Arabia and the early dominance of Turkish people in Central Asia, with marked effects even in China.
21.1.1.1 THE CHRISTIAN CHURCH
We have previously mentioned that in these "Dark Ages" education survived only as a luxury of the clergy. The Roman Church itself could give little or no direction at this time because of chaos in Italy and the lowering of Byzantine prestige. The Emperor Heraclius attempted to regain Syria and Armenia from Persia by conciliating their monophysitism by producing a compromise called "monotheletism" which suggested that the union of God and man in Christ, although not submerging the identity of either, was sufficiently complete to manifest itself outwardly in one divine-human energy. This proposal only irritated the rest of the empire and when the Arabs overran the region it was abandoned. As a last blow, Islam appeared on the world scene in this century to further menace the Christian Church. (Ref. 137 ([188]))
21.1.1.2 ISLAM
Most of the present day taboos of the Islamic religion were present at its inception. The Koran prohibitions include:
1. Pork, as an impurity - chiefly a carry-over from nomad life. One cannot drive pigs on great migrations
2. Animal blood - a pollution legacy from Old Testament Judaism
3. Wine, considered an abomination. It is said that some of the prophet’s early levies had been found too drunk to fight (Ref. 211 ([284]))
As is well known, the original stories from the Koran are much like the Old Testament, with the same early characters, including Abraham and his tribe. Both Judaism and Islam came from the same sources in the desert. Islam was essentially a military empire in the beginning and only became a culture after it absorbed a measure of Persian thought. (Ref. 213 ([288]))
21.1.1.3 JUDAISM
In this and the next few centuries, Jews became more and more isolated as a commercial sect. Especially in northern Europe they were excluded from owning land and the feudal system resulted in the constant threat of confiscation of property and even expulsion from the country. Expulsion started in Spain just after the beginning of the century with an edict from Emperor Heraclius. The Carolingians in Austrasia, France, however, gave them special charters, protection and commercial privileges. (Ref. 8 ([14])) In their native Levant, many Jews converted to Islam and actually contributed much to the final Muslim concepts. (Ref. 213 ([288]))
21.2 Africa: A.D. 601 to 700
21.2.1 AFRICA
21.2.1.1 NORTHEAST AFRICA
The Ethopian upland soils had been largely destroyed, exposing underlying rocks. In the middle of the century, threatened by Muslim neighbors, Axum lost its Red Sea ports and had its gold supply cut off so its Christians retreated to the highlands, where they remained in isolation until the 15th century. Abandoned buildings deteriorated and contributed to the soil destruction. Land abandonment can be as destructive as over-use and there can be little doubt that all this exacerbated Axumite economic decline. (Ref. 270 ([36]))
To the west in Nubia, Coptic Christians thrived. After an Egyptian attack in 651-652 relations between Christian Nubia and Moslem Egypt were formalized by treaty which included an agreement that Nubians would return all runaway slaves to Egypt. A cathedral was built about A.D. 700 in Qasr Ibrim and there were plans to make this a pilgrimage center. Nubia hereafter remained Christian for about 700 years. Just north of the present-day Aswan Dam, the survival of paganism into this 7th century on the island of Philae had been a notable scandal stimulating Byzantine missions into the area. (Ref. 271 ([7]))
Egypt fell to the Persians temporarily in 616 but fell again to the Arabs later in the century, with Alexandria conquered by the latter in 660. The Monophysite Christians of Egypt actually helped the Moslems overthrow the existing administration. After the conquest, Amr ruled for the Arabs and did so well. (Ref. 206 ([83]), 137 ([188]))
21.2.1.2 NORTH CENTRAL AND NORTHWEST AFRICA
In the last third of the century the raiding Moslems easily took Tripolitania but on their original drive westward they were repulsed from Tunisia by Roman Empire troops. Subsequently, however, conversion of the indigenous Berbers to Islam in 696 gave Islam a new push and the Byzantine forces in Tunisia were then overrun and Carthage was destroyed again. Soon Morocco also fell to the Islamic onslaught. Shortly thereafter trade routes for slaves, ivory and gold opened up between Morocco-Algeria and the western Sudan. The Murabits (also Almoravids) of Morocco turned south, shattering the Negro Empire of Ghana.
The Berbers were of an entirely different race from the Arabs, having roundish heads contrasting with the Arabs’ long heads. Even when some were initially converted to Islam, allowing the Moslem advance, most of the Berbers retreated to the naked mountains dividing Tunisia’s coastal plains from the desert. Even so, the Muslims made a greater impact on these people than Rome or Christianity had previously done. (Ref. 137 ([188]), 175 ([241]), 58 ([86]), 83 ([123]), 222 ([296]))
21.2.1.3 SUBSAHARAN AFRICA
From 500 to 1,200 ancient Ghana, in what is now Mali, monopolized the gold trade from west Africa to Europe. It sat at the southern end of the trans-Saharan caravan routes and thus acted as the hub. Kumbi Saleh was a city of 15,000 people. The excavated ruins of the ancient city of Jenne-Jeno had a formidable three meter-wide wall surrounding it which was constructed sometime between 400 and 800. Delicately constructed gold jewelry has been found under this city wall, indicating that this was a trade center over a long period of time. The nearest gold mines were 800 kilometers south of this developing city. (Ref. 268 ([189])) The Muslim invasion of Ghana from the north caused some disruption in administration certainly, but did not destroy the fundamental culture or the developing cities.
In the far southeast of Africa the Leopard’s Kopje people, a Bantu-speaking group, were in control of Great Zimbabwe from about A.D. 600 to 850. (Ref. 45 ([66])) Elsewhere the great bulk of Africa remained as in previous centuries.
21.3 The Near East: A.D. 601 to 700
21.3.1 THE NEAR EAST (AN AMAZING CONQUEST OF THE NEAR EAST BY ISLAMIC ARABS)
It was in this century that the people of Kurdistan were converted to the Sunni variety of Islam. The Kurds are a people closely related ethnically to the Persians, who have tried through the ages to keep themselves intact as sheep-raising and rug weaving nomads, without respect to political boundaries. Kurdistan embraces the present day areas of east TURKEY, Soviet Armenia, northeast Iraq and northwest Iran. (Ref. 38 ([59]))
21.3.1.1 ARABIA AND JORDAN
Muhammad (or Mohammed) was born in the south of Arabia of poor parentage early in the century. He married wealth and soon began to teach a new religion, taking as basic beliefs the monotheism of the Jews. He accepted Jesus as a prophet and formulated a new creed of behavior for his fellow Arabs. He had the visionary power of a seer, the astuteness of a master politician and a poet’s mastery of language. (Ref. 83 ([123])) By the time of his death in A.D. 636 his followers had already become almost fanatical in their zeal to spread the new faith and their armies poured out of the Arabian Peninsula to sell the religion by force of arms. The Arabs’ military success approached the miraculous as they subdued the greatest kingdoms with small armies made up of mounted men on the famed Arabian horses. (Ref. 122 ([170]))
21.3.1.1.1 MEDITERRANEAN COASTAL AREAS OF ISRAEL AND LEBANON & IRAQ AND SYRIA
The early part of the century was a period of some general decay in this entire area, with Persia and Byzantium more or less splitting control. At the death of Emperor Maurice of Byzantium at the hands of his own soldiers, Chosroes II of Persia went on a conquering spree, taking Roman Mesopotamia in 607-615, then Armenia and some of Anatolia itself. But the pestilences which had visited the Romans and Persians alike from 542 on may explain in great part the little resistance their forces offered the Muslim eruption in 634. By the time of the Arab conquest Syria, in general, was an impoverished and stricken land. Damascus, as well as Jerusalem, had not recovered from the effects of the previous long and terrible sieges. Palmyra stood empty. In Mesopotamia there is some evidence that many irrigation canals had been abandoned, probably from a lack of labor supply due to the plague, before the Moslems had even arrived and it is doubtful if the Arabs actually destroyed much. (Ref. 137 ([188]), 140 ([190]))
The first incursion of Arabs into Iraq occurred in A.D. 633 with forces under Khalid ibn-al-Walid, although the main advance was a little to the west into Syria. They defeated the Byzantines in a last battle at Yarmuk in 636 and Jerusalem capitulated in 638. The chief administrator of Iraq and the coastal region from 644 to 656 was Othman (also Uthman) of the Omayyad (also Umayyad) family. Using his nepotism as an excuse, troops from Iraq and Egypt assassinated Othman in Medina in 656 and he was succeeded by Ali, the prophet’s cousin and son-in-law. Mo’awiya, an Omayyad governor of Syria, disputed this succession, proclaimed himself caliph in Jerusalem in 660 and went on to establish a capital at Damascus in 661, initiating the Omayyad Caliphate. Descendants of Ali continued intermittent warfare with the combatants eventually ending up as the northern (Omayyad) Arabs against the southern. The latter were chiefly the Shi’ites and by the end of the century these partisans were more or less in control of Arabia, Persia and Mesopotamia. In addition, the old line of demarcation between Roman Syria and Persian Iraq or Mesopotamia survived this Moslem conquest. A strong sense of difference between the populations at large in these two provinces, fostered by the differences in their respective administrations easily coalesced with long standing rivalries in the two Arab garrisons. Many civil wars resulted. (Ref. 2 ([3]), 119 ([166]))
As the Arab armies overran Mesopotamia and Iran, sizable groups of Jews were pretty well left alone as protected minorities. All aspects of their civil and religious life were administered by Jewish officials in accordance with the Babylonian Talmud. At this time Hindu numerals were in use in Syria and later these became known as "Arabic numerals". (Ref. 49 ([73]))
21.3.1.1.2 IRAN: PERSIA
As the century began Chosroes II ruled the Persians with avarice, suspicion and cruelty and a ruinous taxation to support his own splendid living. His armies fought their way to the Bosporus and to Egypt and came within sight of Constantinople but some 10 years later Emperor Honorius, in alliance with the Khazars just east of the Caspian, struck back, attacking the Persian homeland (623-624). The Persians retaliated by attacking Constantinople once again with Avar help in 626 but the east Roman navy kept the two land forces apart and the attack was a failure. Chosroes II was then murdered by his nobles and his son, Kavadh II, made the final peace, surrendering Egypt, Palestine, Syria, Asia Minor and western Mesopotamia back to the Byzantine Empire. Then pestilence broke out in Persia and thousands died, including the king. There followed a fight for the throne and in this atmosphere of disease and general moral decay and decline came the Arab armies of Islam about 636 and Persia quickly became part of the Moslem realm. The decisive action with the Arabs occurred at Al Qadisiya, Iraq, when the Persian army was literally smashed, allowing Arab capture of the capital, Ctesiphon (very near Selucia in Mesopotamia), in A.D. 635, thus opening the road to the main Iranian plateau. After the take-over a few Persian nobles maintained their independence in the mountains of Tabaristan at the south end of the Caspian. (Ref. 8 ([14]), 137 ([188]))
The Arabs did not force their conquered subjects to embrace Islam but did require them to accept the Koran as divine teaching and obliged them to learn Arabic, thus building an empire united by a common tongue. (Ref. 137 ([188]), 222 ([296])) There were probably many factors in the easy fall of the great Persian Empire to the surging Arab armies. In addition to the factors listed in the paragraph above, it should be realized that both Byzantium and Sassanian Persia had exhausted themselves battling each other for many years. But there was also an economic cause of decline as the use of the Silk Route to China diminished. The Byzantines had smuggled silk cocoons from China and could now supply themselves with silk and the economy suffered all along the old route.
Byzantium had become the original heir of classical Greek medicine but during the persecutions of a number of learned heretics they fled to Persia, where, at Jundishapur, they met Syrian, Persian and Hindu scholars and working together, they translated many important works into Syriac, the new language of learning in the Near East. When Persia fell to the Arabs, many works of medicine were then translated from Syriac into Arabic, including large works of Galen. (Ref. 211 ([284]))
21.3.1.1.3 ASIA MINOR
21.3.1.1.3.1 TURKEY
After Emperor Justinian’s death at the close of the preceding century (595) the eastern Roman Empire collapsed with nothing left except a few Asiatic ports, some fragments of Italy, Africa and Greece. The capital itself was besieged by the Persians under Chosroes II, helped in the north by an army of Avars. In A.D. 602 the "Roman" army fighting the Avars revolted, returned to Constantinople and murdered Emperor Maurice, while the Avars devastated the Balkans. The cross-bow reached Byzantium from central Asia at about this time, perhaps borrowed from the Avars. (Ref. 137 ([188]), 213 ([288]))
The whole of the Asia Minor peninsula had been ploughed and furrowed by Persian armies and the great cities had been plundered and sacked, but the Byzantines still had an unbeaten navy and after 10 years, Heraclius, the new emperor, built a new army, sailed across the Black Sea, marched across Armenia and attacked and defeated Persia from the rear (A.D. 624). The victory was a hollow one, however, as the Arabs soon advanced into this territory with Khalid ibn al-Walid defeating a Byzantine army at the battle of the Yarmuk. The Byzantine frontiers were backed into Turkey, proper, again and after 673 the Moslems even blocked Constantinople both by land and sea, allowing it to be attacked every year for the next five. Only the strength of the city’s walls and the appearance of "Greek fire", an explosive of unknown composition, saved the empire.
Although we have used the terms "Byzantine" and "Byzantium" freely in the last few chapters, actually it was not until the second half of this century that earlier historians applied these names in reference to the eastern Roman Empire. "Byzantion" was the old Greek name for Constantinople, and as the language of this eastern empire became chiefly Greek, the term "Byzantium" came into use. (Ref. 137 ([188]))

Pero gran parte de su éste parece tener raíces en la cultura Adena o Hopewell, y hoy en día se considera la cultura misisispí como una cultura indígena, un resultado de la mezcla de la cultura Hopewell con elementos mexicanos llegados más tarde. El elemento característico de esta cultura es es el montículo piramidal que sirve de cimiento para un templo o una casa del jefe. Algunos centros eran muy pequeños pero otros eran enormes, como Cahokia en East St Louis, Illinois, donde habían más de 85 montículos y donde la superficie del poblado cubría 6 millas (casi 10 kilómetros) a lo largo del rio Ohio. Uno de los montículos más grandes tenía unos 100 pies de altura (más de 30 metros) y 16 acres (casi 6.5 hectáreas) de base. La inmensidad del trabajo que suponía, sin el uso de la rueda o animales de carga, es casi increíble. La totalidad del proyecto debe haber llevado varios cientos de años. La población misisipí era densa, en tanto que 383 poblados bordeaban el rio Misisipí en la corta distancia de aproximadamente 700 millas (algo más de 1100 kilómetros) que separa las entradas de los ríos Ohio y Rojo respectivamente, y otros miles de poblados se repartían por otras zonas del sistema fluvial. (Ref. 64 ([94]))
Si hacemos caso de lo que dice el profesor Fell (Ref. 66 ([97])), las ciencias y matemáticas libias continuaban floreciendo en el sudoeste. Los hohokam seguían con sus migraciones colonizadoras, comenzando su periodo colonial en algún momento antes e 550, y extendiendo artefactos por casi toda Arizona y llevando consigo sus costumbres, que incluían el sagrado juego de pelota. Más lejos, en el nordeste, los anasazi o pueblo continuaban su avance con diseños de cerámica muy superiores y un comercio en aumento, importando conchas de abulón y turquesas. (Ref. 269 ([193])). De una fuente todavía desconocida obtuvieron el arco y la flecha, y desarrollaron el hacha con empuñadura. Se produjo un aumento de la agricultura, con el cultivo de maíz, calabaza y legumbres, que añadieron proteína a su dieta. La población aumentó y sus asentamientos de extendieron, llegando incluso a excavar viviendas en los acantilados del Gran Cañón. (Ref. 277 ([37]))
20.9.1.2 MÉXICO, AMERICA CENTRAL Y EL CARIBE
En el Valle de México, Tehotihuacán se encontraba en la cúspide de su poder y era más grande que la Roma imperial, con una población estimada en 125.000 individuos en un área de 20 km2. (Ref. 8 ([14])). Era una capital religiosa y cultural y un centro económico y político de gran importancia en la zona de América Central, Mexico y el Caribe (zona conocida como América Media). Su poder se extendió rápidamente debido a la tendencia a entremezclarse de las diferentes tribus y culturas, con lo que había una fuerte presencia mexicana incluso en Kaminaljuyu (la actual ciudad de Guatemala). Hasta en la región maya se encuentran tradiciones artísticas con reminiscencias de las de Tehotihuacan, como en el caso de Tikal, aunque esta solo era una quinta parte de la ciudad mexicana en tamaño.
Los mayas hablaban una variedad de lenguas, todas emparentadas pero ininteligibles entre sí. Habían divisiones principales – los grupos de las tierras bajas, que incluyen la lengua yucateca, la cholana y la chortí y los de las tierras altas (guatemaltecas), que incluyen la mameana y la quicheana. Los mayas eran cultos y profundamente intelectuales, y ya hemos hablado de sus matemáticas (0 a 100 d. C. (Sección 15.9.1.1.3: MEXICO, AMERICA CENTRAL Y EL CARIBE) y de su astronomía (301 A 400 d. C. (p. 281)) con anterioridad. En estos momentos se produjo un renacer de la cultura maya en las ciudades del Yucatán, que fue suplantando gradualmente la importancia de Petén en el sur. (Ref. 177 ([243]), 146 ([199]), 215 ([290]), 163 ([222])) De acuerdo con tradiciones, escrituras pictóricas y manuscritos mexicanos escritos después de la conquista, los toltecas fueron desterrados de su país nativo al nordeste de México en 596 y se dirigieron hacia el sur. (Ref. 205 ([276]))
Este siglo marca el inicio del periodo V de la prehistoria de Costa Rica, en el que cada una de las tres zonas arqueológicas se desarrollaron independientemente. En Guanacaste-Nicoya se produjo el inicio de la conocida tradición de cerámica policromada Nicoya, que tiene un gran parecido con la cerámica maya del período tardío clásico de Honduras y El Salvador. En Panamá el progreso parece haberse detenido y este país nunca conoció el desarrollo de ninguna sociedad centralizada en el estado, como fue el caso en las regiones centroamericanas de más al norte (Ref. 266 (67]))
20.9.1.3 AMÉRICA DEL SUR
20.9.1.3.1 NORTE Y OESTE DE AMÉRICA DEL SUR
A lo largo de diversas zonas del valle del rio Magdalena, en Colombia, y particularmente cerca de San Agustín, se encuentran enormes montones de detritos, algunos de los cuales se han excavado y han revelado monolitos esculpidos, lo que indica la existencia de un gran centro ceremonial del estilo de los complejos mayas. La datación con radio-carbono indica que en esta zona había actividad en el siglo VI, que continuó por otros 1000 años. Su similitud tanto con los olmecas como con la isla de Pascua nos hace preguntarnos si este santuario tiene un origen local o si, por el contrario, lo tiene en algún pueblo que migró de América Central o incluso de la Polinesia. Justo al este de Popayan, en una calurosa zona al este de la Colombia andina se encuentra un valle interior y aislado llamado “Tierradentro”, donde se encuentran interesantes monumentos posiblemente originarios de la misma época, aunque pudiera haber sido una sociedad secundaria que hubiera existido unos mil años después. No se ha efectuado una datación precisa. Las tumbas fueron saqueadas mucho tiempo atrás, probablemente para robar oro y joyas, pero hay tres estatuas de dimensiones considerables que representan deidades antropomórficas similares a las de la isla de Pascua, y que son comparables a las de San Agustín. (Ref. 62 ([91]))
En este siglo, Perú estaba dividido en nueve regiones separadas, cada una con su propio estilo artístico local. Los moche, o sus descendientes, y los nazca fueron superiores, pero otros estados con cierta trascendencia fueron Cajamarca, Recuary, Lima, Huarpa, Waru, Tiahuanaco y Atacameno. Todos ellos utilizaban en oro, la plata y el cobre para fabricar herramientas además de joyas. Alrededor del año 500 se origina en Ecuador la cultura de los milagro, que se destaca por su elaborado trabajo del oro y por sus montículos artificiales destinados a lugares de entierro o de residencia. Algunos de estos últimos parecen estar asociados con sistemas de colinas o de terraplenes, que probablemente se realizaban para permitir el cultivo de tierras que dependía de las inundaciones estacionales. Esta cultura puede haber sido una derivación de la cultura moche de Perú, descrita en capítulos anteriores. Este tipo de colinas se encuentran también en Bolivia y Colombia donde cubren millones de metros cuadrados, y están presentes a su vez cerca del lago Titicaca, aunque estas no han sido datadas. (Ref. 9 ([15]), 62 ([91]))
20.9.1.3.2 ESTE DE AMERICA DEL SUR
En la selva amazónica existían tribus que practicaban la agricultura de la mandioca. Más al sur, las tribus tupí-guaraníes habían emigrado desde la cuenca del Amazonas hasta la selva y la sabana brasileñas. Alrededor del año 600 se desarrolla en lo que es Argentina la cultura aguada, que se caracterizaba por su cerámica negra y amarilla con motivos felinos (Ref. 8 ([14]), 45 ([66]))

21.1.1 601 a 700 d. C.
La característica principal de este siglo es la persistencia de la “Edad Oscura” en Europa, la increíble irrupción de los ejércitos árabes y la religión musulmana del desierto de Arabia y el dominio temprano de los turcos en Asia central, cuyos efectos llegaron incluso a China.
21.1.1.1. LA IGLESIA CRISTIANA
Ya hemos mencionado que en esta Edad Oscura la educación sobrevivió exclusivamente como un lujo del clero. La Iglesia romana no podía ofrecer prácticamente dirección alguna debido al caos que se vivía en Italia y al descenso del prestigio bizantino. El emperador Heraclio intentó recuperar Siria y Armenia de los persas conciliando su monofisismo en una solución de compromiso llamada “monoteletismo”, que sugería que la unión de las identidades divina y humana en Cristo, sin anular ninguna de sus identidades, era suficientemente completa para manifestarse como una energía divino-humana. Esta propuesta solo hizo que irritar al resto del imperio y cuando los árabes invadieron la región, fue abandonada. Como estacazo final, durante este siglo hizo su aparición el Islam para amenazar más si cabe a la Iglesia cristiana. (Ref. 137 ([188]))
21.1.1.2 EL ISLAM
La mayoría de los tabúes actuales de la religión islámica estaban ya presentes en su nacimiento. Las prohibiciones del Corán incluyen:
1. La carne de cerdo se considera una impureza. Una consecuencia de la vida nómada. No es posible el transporte de cerdos en los grandes viajes.
2. Sangre animal – una contaminación que proviene del judaísmo del Antiguo Testamento
3. El vino, está considerado una abominación. Se dice que a algunos de los primeros reclutas del profeta se los encontraron demasiado borrachos para combatir. (Ref. 211 ([284]))
Como es bien sabido, las historias originales del Corán son muy similares a las del Antiguo Testamento, con los mismos personajes principales, que incluyen a Abraham y su tribu. Tanto el judaísmo como el islam provienen de las mismas fuentes en el desierto. Al inicio, el islam era esencialmente un imperio militar que se convirtió en una cultura tras absorber algo del pensamiento persa.
21.1.1.2 EL JUDAÍSMO
En este siglo y los siguientes, los judíos fueron aislándose más y más como una secta comercial. Especialmente en Europa del norte, se les prohibió ser propietarios de tierras y con el sistema feudal hubo una constante amenaza de confiscación de sus propiedades e incluso de expulsión del país. La expulsión comenzó en España justo después de principios del siglo con un edicto del emperador Heraclio. Sin embargo, los carolingios de Austrasia, en Francia, les concedieron derechos especiales, protección y privilegios comerciales. (Ref. 8 ([14])) En su nativo levante, muchos judíos se convirtieron al islam y de hecho contribuyeron en gran medida a conformar los conceptos musulmanes definitivos. (Ref. 213 ([288]))
21.2 África: 601 a 7005 d. C.
21.2 ÁFRICA
21.2.1.1 NORDESTE DE ÁFRICA
En Etiopía, el suelo de las tierras altas había sido destruido en su mayor parte y solo quedaba el subsuelo de roca. A mediados de siglo, amenazado por sus vecinos musulmanes, Axum perdió sus puertos del Mar Rojo y se quedó sin suministros de oro, con lo que sus cristianos se retiraron a las tierras altas, donde permanecieron aislados hasta el siglo XV. Los edificios abandonados se deterioraron y contribuyeron a la degradación del suelo. El abandono de las tierras puede ser tan destructivo como su sobreutilización, y no hay duda de que todo esto contribuyó el declive económico axumita. (Ref. 270 ([36]))
Al oeste, en Nubia, los cristianos coptos florecían. Después de un ataque egipcio en 651-652, las relaciones entre la Nubia cristiana y el Egipto musulmán se formalizaron en un tratado que incluía un acuerdo para que los nubios devolvieran todos los esclavos huidos a Egipto. Se construyó una catedral hacia el año 700 en Qasr Ibrim y había planes para hacer de esta un centro de peregrinaje. Nubia continuó siendo cristiana durante unos 700 años. Justo al norte de lo que hoy en día es la presa de Aswan, la supervivencia del paganismo en la isla de Philae en este siglo VII supuso un escándalo importante que estimuló las misiones bizantinas en la zona (Ref. 271 ([7]))
Egipto cayó frente a los persas temporalmente en 616, pero más adelante volvió a caer a manos de los árabes, que conquistaron Alejandría en el 660. Los cristianos monofisitas de Egipto ayudaron de hecho a los musulmanes a derrocar el gobierno existente. Tras la conquista, Amr gobernó a los árabes y lo hizo bien. (Ref. 206 ([83]), 137 ([188}))
21.2.1.2 CENTRO NORTE Y NOROESTE DE ÁFRICA
En el último tercio del siglo los musulmanes tomaron Tripolitania sin problemas, mas en su ruta hacia el oeste fueron repelidos de Túnez por las tropas del imperio romano. Posteriormente, sin embargo, la conversión de los indígenas bereberes6 al islam en 696 le dio a esta religión un nuevo empuje, con lo que las fuerzas bizantinas en Túnez fueron entonces adelantadas y Cartago fue destruido de nuevo. Marruecos no tardó en sucumbir a la arremetida islámica. Poco después se abrieron las rutas comerciales de esclavos, marfil y oro entre Marruecos y Argelia y el oeste de Sudán. Los morabitos (o almorávides) de Marruecos se fueron hacia el sur, destrozando el imperio Negro de Ghana.
Los bereberes pertenecían a una raza completamente distinta de la de los árabes, con cabezas más redondas que contrastan con el cráneo alargado de los árabes. Aunque algunos se convirtieron inicialmente al islam, lo que permitió el avance musulmán, la mayoría de ellos se retiró a las peladas montañas que separan las planicies costeras de Túnez del desierto. Aun así, los musulmanes produjeron un impacto mucho mayor en este pueblo que el producido por Roma o la cristiandad con anterioridad. (Ref. 137 ([188]), 175 ([241]), 58 ([86]), 83 ([123]), 222 ([296]))
21.2.1.3 ÁFRICA SUBSAHARIANA
Desde el año 500 al 1200 la antigua Ghana, en lo que ahora es Mali, monopolizó el comercio del oro desde el oeste de África a Europa. Su situación en el extremo sur de la ruta de las caravanas transaharianas lo convirtió en un eje. Kumbi Saleh era una ciudad de 15000 personas. Las ruinas arqueológicas de la antigua ciudad de Jenne-Jeno muestran una formidable muralla de tres metros de ancho que se construyó en algún momento entre los años 400 y 800. Se ha encontrado joyería de oro delicadamente elaborada bajo esta muralla, lo que indica que este era un centro de comercio durante un largo periodo de tiempo. Las minas de oro más cercanas estaban a 800 kilómetros al sur de esta ciudad en desarrollo. (Ref. 268 ([189]) La invasión musulmana de Ghana desde el norte causo ciertamente alguna alteración en su administración, pero no destruyo la cultura fundamental o las ciudades en desarrollo.
En el lejano sudeste de África, el pueblo que habitaba Leopard’s Kopje, que hablaba la lengua bantú, ostentó el dominio de Gran Zimbabwe desde aproximadamente el año 600 hasta el 850. (Ref. 45 ([66]). En el resto de África no se produjeron cambios respecto a los siglos anteriores.
21.3 El próximo oriente: de 601 a 700 d. C.
21.3.1 EL PROXIMO ORIENTE (UNA CONQUISTA IMPRESIONANTE DEL PROXIMO ORIENTE POR PARTE DE LOS ARABES ISLAMICOS)
Fue en este siglo cuando los pobladores del Kurdistán se convirtieron a la variedad suní del islam. Los kurdos son un pueblo étnicamente muy cercano a los persas, los cuales han intentado a lo largo de los siglos conservarse intactos como nómadas que se dedican al pastoreo de ovejas y al tejido de alfombras, sin preocuparse de las fronteras políticas. En la actualidad, el Kurdistán ocupa zonas del este de Turquía, la Armenia soviética, nordeste de Irak y noroeste de Irán. (Ref. 38 ([59]))
21.3.1.1 ARABIA Y JORDANIA
Mahoma nació a principios de siglo en una familia humilde del sur de Arabia. Se casó con una mujer rica y en seguida empezó a enseñar una nueva religión, tomando como base de su creencia el monoteísmo de los judíos. Aceptó a Jesús como profeta y formuló un nuevo credo de comportamiento para sus compatriotas árabes. Tenía el poder visionario de un adivino, la astucia de un maestro de la política y el dominio del lenguaje de un poeta. (Ref. 83 ([123])) En el momento de su muerte en 636 d. C., sus seguidores ya se habían vuelto prácticamente unos fanáticos en su celo por difundir su fe, y sus ejércitos salieron de la península de Arabia en tropel para vender la religión por la fuerza de las armas. El éxito militar de los árabes fue casi un milagro, pues lograron someter a los más grandes reinos con unos ejércitos poco numerosos de hombres montados en los famosos caballos árabes. (Ref. 122 (170]))
21.3.1.1.1 ZONAS COSTERAS MEDITERRANEAS DE ISRAEL, LIBANO E IRAK Y SIRIA
La primera parte del siglo fue un periodo de decadencia generalizada en toda esta zona

en la que Persia y Bizancio se repartían el control. A la muerte del emperador Mauricio de Bizancio a manos de sus propios soldados, Cosroes II de Persia se lanzó a una fiebre conquistadora en la que tomó la Mesopotamia romana en 607-615, luego Armenia y algo de la misma Anatolia. Pero la peste que había afligido tanto a romanos como persas desde 542 explicaría en parte la poca resistencia que sus fuerzas ofrecieron a la invasión musulmana de 634. En el momento en que se produjo su conquista por parte de los árabes, Siria era una tierra empobrecida y afligida. Damasco, al igual que Jerusalén, no se había recuperado de los efectos de los largos y terribles sitios anteriores. Palmira permanecía vacía. En Mesopotamia hay cierta evidencia de que muchos canales de irrigación habían sido abandonados, probablemente a causa de una falta de mano de obra debido a la plaga, antes incluso de que los musulmanes llegaran, y de hecho es poco probable que los árabes realmente destruyeran mucho. (Ref. 137 ([188], 140 [190]))
La primera incursión de los árabes en Irak se produce en 633 d. C. con fuerzas bajo el mando de Khalid ibn-al-Walid, aunque el avance principal se produjo hacia el oeste, dentro de Siria. Derrotaron a los bizantinos en la batalla de Yarmuk en 636, y Jerusalén capitulo en 638. El jefe administrador de Irak y su región costera desde 644 a 656 era Otmán (o Uthman) de la familia Omeya. Tomando su nepotismo como excusa, tropas de Egipto e Irak asesinaron a Otmán en Medina en 656, y este fue sucedido por Ali, primo y yerno del Profeta. El gobernador omeya de Siria, Mo’awiya, disputó su sucesión, se autoproclamó Califa8 el 660 en Jerusalén, estableció la capital en Damasco en 661, dando origen al califato Omeya. Los descendientes de Ali continuaron en guerra intermitente con los combatientes y con el tiempo acabaron siendo los árabes del norte (Omeyas) contra los del sur. Estos últimos eran principalmente chiitas, y para el final del siglo estos controlaban Arabia, Persia y Mesopotamia. Además, la antigua línea divisoria entre la Siria romana y el Irak persa o Mesopotamia sobrevivió a esta conquista musulmana. Un fuerte sentido diferenciador entre las poblaciones de estas dos provincias, fomentado por las diferencias entre sus respectivas administraciones, se fusionó fácilmente con una rivalidad histórica entre las dos guarniciones árabes. De ello resultaron numerosas guerras civiles. (Ref. 2 ([3]), 119 ([166]))
Mientras los ejércitos árabes arrasaban Mesopotamia e Irán, algunos grupos considerables de judíos se les dejó en paz como minorías protegidas. Todos los aspectos de su vida religiosa y civil eran administrados por las autoridades judías de acuerdo con el Talmud de Babilonia. En este momento en Siria se utilizaban los números hindúes y más tarde a estos se les conoció como “números arábigos”. (Ref. 49 ([173]))
21.3.1.1.2 IRÁN: PERSIA
A principios de siglo los persas estaban gobernados por Cosroes II, cuyo reinado se caracterizó por su avaricia, recelo y crueldad, así como por un sistema de impuestos ruinoso para la población con el que costeaba su lujoso estilo de vida. Sus ejércitos alcanzaron el Bósforo y Egipto, hasta las puertas de Constantinopla, pero unos 10 años después el emperador Honorio contraatacó, arremetiendo contra la propia patria de los persas (623-624), con la ayuda de los jázaros al este del mar Caspio. Los persas se vengaron atacando Constantinopla de nuevo con ayuda de los ávaros en 626, pero la armada del impero romano de oriente mantuvo separadas las dos fuerzas terrestres y el ataque fue un fracaso. Cosroes II fue asesinado por sus nobles, y su hijo, Kavad II, se rindió finalmente y devolvió Egipto, Palestina, Siria, Asia Menor y el oeste de Mesopotamia al imperio Bizantino. Una epidemia de peste asoló Persia y murieron miles de personas, incluido el Rey. Esto ocasionó una lucha por el trono, y en este ambiente de enfermedad, moral baja y decadencia llegaron las tropas árabes del islam, hacia 636, con lo que Persia no tardó en pasar a formar parte del reino musulmán. La acción que resultó decisiva para los árabes sucedió en Al Qadisiya, en Irak, cuando el ejército persa fue literalmente aplastado, permitiendo a los árabes captura la capital, Ctesifonte (muy cerca de Seleucia, en Mesopotamia), en el año 635, con lo que abrieron el camino al altiplano principal de Irán. Tras la conquista, unos pocos nobles persas mantuvieron su independencia en las montañas de Tabaristán, en el extremo sur del Caspio. (Ref. 8 ([14]), 137 ([188]))
Los árabes no obligaron a sus nuevos súbditos a adoptar el islam pero sí les exigieron que aceptaran el Corán como enseñanza sagrada y les obligaron a aprender árabe, construyendo así un imperio unificado por una lengua común. (Ref. 137 ([188]), 222 ([296])) Muchos factores fueron los que probablemente intervinieron en la rápida caída del gran imperio persa a manos de los ejércitos árabes. Además de los ya listados en el párrafo de más arriba, hay que darse cuenta de que tanto Bizancio como el imperio Sasánida se habían agotado a sí mismos con las luchas mantenidas entre ellos durante muchos años. Pero hubo también una causa económica del declive: la disminución del uso de la ruta de las seda hacia China. Los bizantinos habían sacado capullos de seda de contrabando de China y se proveían a ellos mismos, con lo que la economía sufrió a todo lo largo de la antigua ruta.
Bizancio había sido el heredero original de la medicina clásica griega, pero durante las persecuciones de algunos eruditos herejes, estos huyeron a Persia, donde se encontraron, concretamente en Jundishapur, con sabios sirios, persas e hindúes con los que trabajaron conjuntamente y tradujeron muchas obras importantes al siriaco, la nueva lengua de aprendizaje en el Próximo Oriente. Cuando Persia cayó a manos de los árabes, muchas obras sobre medicina fueron traducidas del siriaco al árabe, incluyendo las extensas obras de Galeno. (Ref. 211 ([284]))

21.3.1.1.3 ASIA MENOR
21.3.1.1.3.1 TURQUíA
Tras la muerte del emperador Justiniano a finales del siglo anterior (595), el imperio romano de Oriente cayó y no quedaron más que algunos pocos puertos asiáticos y algunos fragmentos de Italia, África y Grecia. La capital fue sitiada por los persas bajo las ordenes de Cosroes II, asistidos en el norte por un ejército de ávaros. En el 602, el ejército “romano” que luchaba contra los ávaros se sublevó, regreso a Constantinopla y asesinó al emperador Mauricio, mientras los ávaros arrasaban los Balcanes. Más o menos en este tiempo, la ballesta llegó a Bizancio desde Asia central, posiblemente prestada de los ávaros. (Ref. 137 ([188]), 213 ([288]))
La totalidad de Asia Menor fue arrasada por los ejércitos persas y las grandes ciudades habían sido saqueadas y expoliadas, pero los bizantinos tenían una fuerza naval que no había resultado todavía vencida, por lo que 10 años después, Heraclio, el nuevo emperador, construyó un nuevo ejército, navego a través del Mar Negro, cruzó Armenia y atacó y venció a Persia desde atrás (624 d. Mumbai Smiles, a non-profit organisation was founded in 2005, by a Spanish journalist and writer, Jaume Sanllorente, with the pursuit of “peaceful struggle against poverty” in the city of Mumbai, financial capital of India. Mumbai is the city of dreams, however there is a cruel reality behind all the glitz.
Mumbai Smiles aspires to eradicate poverty and get social justice for the most disadvantaged communities in the city. Today, our projects are geared to generate social transformation through self-sufficiency and access to equal rights and livelihood opportunities for the underprivileged communities living in the slums of Andheri East and the surroundings, focusing on Health, Education, Livelihood and Awareness programs. Our campaigns include awareness drives to denounce the Human Rights denial and social exclusion suffered by millions of Mumbai citizens.
We have engaged in multiple projects to empower these communities through this peaceful fight for over a decade now, encouraging participation from within the communities – we work with them; not for them - and creating a cooperative urban development framework to shape up a new reality. So far, over 7000 beneficiaries have reaped the benefits of our work that includes a realistic vision of social inclusion, gender mainstreaming and promotion of Human Rights.
WHERE WE WORK
Mumbai. This one word encapsulates a plethora of dreamy facts - a melting pot of diverse culture, hub of Bollywood glamour, fifth largest city in the world, financial capital of India, generating 5% of India’s GDP alone, glittering with swanky malls, multiplexes, heritage tourist attractions and home to the most expensive residential behemoth of the world. Yet, there is a hidden side to this megacity. It is also home to Asia’s largest slum complex.
Mumbai has a population of almost 22 million citizens (World Population Prospects – United Nations, 2014), and around 60% of it lives in slums (Harvard South Asian Institute, 2015) with little or no access to the most basic civic services of education, public health or even sanitation. Poverty and social inequality give rise to several associated issues, which in effect seem to create an unsolvable equation, where basic human rights cease to exist and stark statistics come to the fore.
We, at Mumbai Smiles, focus on select slums in the northern area of Mumbai city, Andheri East, which forms a crucial part of this equation and work to improve the living conditions of these marginalised communities through community interference, programs, initiatives, sensitisation and participation. Together with these communities, we aspire to see Mumbai rise above the vicious circle of poverty and denial of basic rights with our projects involving Education, Health and Livelihood.

Aun así, esta mega ciudad tiene un lado oscuro. También es hogar de la barriada de chabolas más grande de toda Asia.
Bombay tiene una población de casi 22 millones de habitantes (Expectativas de Población Mundial – Naciones Unidas 2014), y casi el 60% de estos vive en barrios de chabolas (Harvard South Asian Institute) con escaso o nulo acceso a los servicios cívicos más básicos como son la educación, la salud pública o incluso la higiene.

Defined terms

PART 2: DIRECTORS
DIRECTORS’ POWERS AND RESPONSIBILITIES
Directors’ general authority
Subject to the Companies Act and the articles, the directors: (a) shall manage the company’s business; and
(b) may exercise all the powers of the company for any purpose connected with the company’s business.
Members’ reserve power
(1) The members may, by special resolution, order the directors to act, or refrain from acting, in a particular way
(2) No such special resolution shall invalidate anything which the directors have already done.
DECISION-MAKING BY DIRECTORS
Directors to take decisions collectively
(1) This article applies to any matter in respect of which the directors have not delegated their powers and responsibilities to a single director.
(2) Subject to the articles, the directors must not act in relation to any such matter unless they have taken a decision about it:
(a) at a directors’ meeting, or
(b) in the form of a directors’ written resolution, in accordance with the articles.
Calling directors’ meetings
(1) Any director may call a directors’ meeting.
(2) The company secretary shall call a directors’ meeting if a director so requests.
(3) A meeting is not called unless reasonable notice of it has been given, indicating its proposed date, time, place and subject matter.
(4) Notice must be given to all the directors, except those:
(a) to whom it is not possible to give reasonable notice; or
(b) who waive their entitlement to notice, prospectively or retrospectively. (5) Notice of a directors’ meeting need not be given in writing.
(6) The reasonableness of any notice period shall be determined by reference to: (a) the urgency and importance of the meeting’s subject matter; and
(b) individual directors’ ability to receive notice of or participate in the meeting.
Quorum for directors’ meetings
(1) At a directors’ meeting, unless a quorum is participating, no proposal shall be voted on, except a proposal to call another meeting.
(2) The quorum for directors’ meetings may be fixed from time to time by: (a) a decision of the directors, or
(b) an ordinary resolution,
but it shall never be less than two, and unless otherwise fixed it shall be two.
(3) Subject to the articles, a director who is interested in an actual or proposed transaction or arrangement with the company shall not be counted as participating in any directors’ meeting, or part of a directors’ meeting, relating to that transaction or arrangement.

Source text - English Common law is generally uncodified. This means that there is no comprehensive compilation of legal rules and statutes. While common law does rely on some scattered statutes, which are legislative decisions, it is largely based on precedent, meaning the judicial decisions that have already been made in similar cases. These precedents are maintained over time through the records of the courts as well as historically documented in collections of case law known as yearbooks and law reports. The precedents to be applied in the decision of each new case are determined by the presiding judge. As a result, judges have an enormous role in shaping American and British law. Common law functions as an adversarial system, a contest between two opposing parties before a judge who moderates. A jury of ordinary people without legal training decides on the facts of the case. The judge then determines the appropriate sentence based on the jury’s verdict.
Civil Law, in contrast, is codified. Countries with civil law systems have comprehensive, continuously updated legal codes that specify all matters capable of being brought before a court, the applicable procedure, and the appropriate punishment for each offense. Such codes distinguish between different categories of law: substantive law establishes which acts are subject to criminal or civil prosecution; procedural law establishes how to determine whether a particular action constitutes a criminal act, and penal law establishes the appropriate penalty. In a civil law system, the judge’s role is to establish the facts of the case and to apply the provisions of the applicable code. Though the judge often brings the formal charges, investigates the matter, and decides on the case, he or she works within a framework established by a comprehensive, codified set of laws. The judge’s decision is consequently less crucial in shaping civil law than the decisions of legislators and legal scholars who draft and interpret the codes.

A. THE SELLER
1. CAPACITY
1.1 The Seller is a company duly organised and validly existing under the laws of England and Wales.
1.2 The Seller has the full right and title of the Shares (defined in the Share Purchase Agreement as the shares of the Company A), free from any Security Interest (defined in SPA).
1.3 The Seller has the requisite power and authority to execute this Agreement and perform its obligations and the transactions contemplated in this Agreement.
1.4 The execution of, and the performance by the Seller of its obligations under this Agreement will not:
1.4.1 result in a breach of any provision of its articles of association; or
1.4.2 result in a breach of any order, judgement or decree of any Competent Authority to which it is a party or by which it is bound and which is material in the context of the transactions contemplated by this Agreement.
1.5 Other than as referred to in this Agreement, no consents, approvals, authorisation or permits are required to be obtained by the Seller in connection with the execution and performance of this Agreement.
1.6 To the best of the Seller's knowledge, no insolvency proceedings have been commenced against the Seller and the Companies for its winding up or dissolution, nor has an insolvency administrator, liquidator or similar officer been appointed with respect to any or all of the Seller’s assets which would prevent the Seller and the Companies from fulfilling its obligations under this Agreement.
