To ensure the obligations undertaken in this contract, the LESSEE, because it is in their interest, hereby provides as surety bond to the LESSOR, the Capitalization Bond(s) in face value of R$ 36,500.00 (thirty-six thousand and five hundred), undersigned by , represented by proposal/form no. .
Para garantir as obrigações assumidas neste contrato, o(a) LOCATÁRIO(a), por ser de seu interesse, dá neste ato, em Caução ao(à) LOCADOR(A), o(s) Título(s) de Capitalização no valor nominal de R$ 36.500,00 (Trinta e seis mil e quinhentos), subscrito(s) pela Porto Seguro Capitalização S.A., representado pela proposta/formulário n.º ____.
First paragraph: should the LESEE not observe any of the clauses of the present lease contract, the LESSOR or agency that represents them is hereby authorized to withdraw the Capitalization Bond(s) at any moment, even before the end term of the capitalization, respecting the withdrawal table, with the due monetary adjustment, regardless of judicial summons or extrajudicial communication, with the purpose of the amount withdrawn settling any amount that may be owed due to debits originated from this contract, respecting the terms described in the Capitalization Bond’s general terms and conditions.
Parágrafo primeiro: se o(a) LOCATÁRIO(A) não observar quaisquer das cláusulas do presente contrato de locação, fica, desde já, o(a) LOCADOR(A) ou a Administradora que o represente, autorizado a resgatar o(s) Título(s) de capitalização, a qualquer momento, mesmo antes do prazo final de capitalização, respeitando a tabela de resgate, inclusive com a correção devida, independentemente de interpelação judicial ou extrajudicial, a fim de que o valor do resgate quite eventual importância que lhe seja devida em razão de débitos oriundos deste contrato, respeitando os termos descritos nas condições gerais do título de capitalização.
Second paragraph: in the hypothesis of the LESEE contesting the amount presented and filing the proper injunction for rendering of accounts, the LESEE will be responsible for all consequent expenses, including procedural costs and attorney fees, unless in this procedure, the court decides in favor of the lessee and redistributes the burden of such costs and judicial fees.
Parágrafo segundo: a hipótese do(a) LOCÁTARIO(A) contestar o valor apresentado e ajuizar a competente ação cautelar de prestação de contas, correrão por conta do(a) mesmo(a) todas as despesas consequentes, inclusive custas e honorários advocatícios, a não ser que na referida ação, a justiça decida a favor do Locatário e redistribua os ônus sucumbenciais.
Third paragraph: during the term of the present lease contract, the withdrawal of the Capitalization Bond by the LESSEE will only occur with the express consent of the LESSOR.
Parágrafo terceiro: durante a vigência deste contrato de locação, o resgaste do título de capitalização pelo LOCATÁRIO (A) somente poderá ocorrer com expressa anuência do (a) LOCADOR (A).
Fourth paragraph: at the end of the lease term, as long as all obligations deriving from this contract are met by the LESEE, including the vacating of the property and the handover of the keys, without the existence of any debit on the LESEE’s part to the LESSOR, the surety bond of the Capitalization Bond(s) presented will be released with Porto Seguro Capitalização S.A.. For that, a severance document for the lease must be presented, signed by LESSOR and LESEE, with notarized signatures, as well as other documents required by the Capitalized Savings Company.
Parágrafo quarto: ao término do prazo de locação, desde que cumpridas pelo(a) LOCATÁRIO(A) todas as obrigações decorrentes deste contrato, inclusive, a desocupação do imóvel e entrega das chaves sem a existência de qualquer débito do (a) LOCATÁRIO (A) para com o LOCADOR (A), será liberado junto à Porto Seguro Capitalização S.A. a caução do(s) Título(s), apresentado(s). Para tanto, deverá ser apresentado documento rescisório da locação firmado pelos(as) LOCADOR(A) e LOCATÁRIO(A), com o reconhecimento de firma das assinaturas, bem como outros documentos requeridos pela Sociedade de Capitalização.
Fifth paragraph: for the fulfillment of the provisions in the first paragraph, the authorization granted to the LESSOR/Agency to withdraw the bond is based on the judicial nature of such a modality of Capitalization Bond, called “Warranty Instrument”, which seeks to ensure compliance to the obligations that were contractually assumed before third parties, in the terms of SUSEP circular letters no. 569/2018 and 576/2018.
Parágrafo quinto: para efeito do cumprimento do disposto no parágrafo primeiro a autorização concedida ao (à) LOCADOR (A)/Administradora, para resgatar o título decorre da própria natureza jurídica desta modalidade de título de capitalização denominada “instrumento de Garantia”, que visa assegurar o cumprimento de obrigações assumidas contratualmente perante terceiros, nos termos das Circulares SUSEP n° 569/2018 e 576/2018.
Sixth paragraph: Except as expressly modified by this Addendum, all other terms and conditions of the Lease Agreement shall remain the same and are hereby ratified and affirmed.
Parágrafo sexto: Exceto quando expressamente modificado por este aditivo, todos os outros termos e condições do Contrato de Locação permanecerão os mesmos e são aqui ratificados e confirmados.
