El delito de defraudación por administración fraudulenta se da cuando "se efectúa una entrega de dinero destinada a que el receptor cumpla un determinado fin con el bien puesto a su disposición: quien acepta el encargo sobre bienes o intereses pecuniarios ajenos, toma a su cargo el deber de cuidar de ellos y si quebranta esta fidelidad, incurre en el delito". Y el perjuicio subsiguiente, consistente en "una disminución del valor económico del patrimonio del sujeto pasivo consecuencia de un ataque fraudulento a uno o varios elementos que lo integran."

injured party

This clearly refers to the victim of the fraud, but I think that the source would have surely said 'victima' if the associated overtones were intended. 'Offended party' would work, but 'injured party' and 'injury' is more commonly used in U.S. legal documents. Depends on your target country.

Just like that...is the person who is affected by the fraud of not complying with what was requested (by the active subject).

The passive subject of the crime is the one against whom the compelling conduct is applied. In this regard, the law protects everyone, thus it does not matter whether the victim possesses the object lawfully, or, for instance, he stole it from someone else.
