وحيث ينعي الطاعنين بالسبب الثاني علي الحكم المطعون فيه مخالفة القانون والخطأ في تطبيقه وتأويله ومخالفة الثابت بالمستندات والفساد في الاستدلال والقصور في التسبيب والاخلال بحق الدفاع اذ اهدر دفاعهم الجوهري بندب خبير في الدعوي وقرر العدول عن الحكم التمهيدي الصادر من المحكمة بندب خبير بتاريخ 8/2/2021 تأسيساً علي ان أوراق الدعوي ومستنداتها بحالتها الراهنة كافية لتكوين عقيدة المحكمة للفصل في طلبات الطاعنين رغم ان طلبهم سالف الذكر شكل وسيلة اثبات جوهرية في شأن واقعة التوقيع علي الاتفاقية موضوع الدعوي وهو دفاع جوهري يتوقف عليه تغيير وجه الرأي في الدعوي بما يعيب الحكم المطعون فيه ويستوجب نقضة.
