Contestatie a unei decizii de concediere. Reclamanta invoca faptul ca respectiva concediere a fost dispusa din "motive personale". Mai apar si „caracterul personal al deciziei de concediere” etc. Nu stiu daca ar merge sa ma indepartez de termenul original si sa folosesc ceva gen „discretionar”... pentru ca „for personal reasons/ground” cred ca ar genera o confuzie groaznica.

I think I will have to use your idea, Annamaria. As far as I understand from UK law, the right concept is "unfair dismissal" but this is not an accurate translation of the original:(.

She's just quoting from the text, I don't think the term is put in speech marks in the text itself.

"..." I think the fact that this term has been put in speech marks implies to me that it was taken from somebody's conversation or report, i.e. a more colloquial term rather than strictly legal here.

E complicată treaba, pentru că există concediere justă din motive legate de persoana angajatului (http://www.codulmuncii.ro/titlul_2/capitolul_5/sectiunea_3_1... Aici probabil angajata susţine că nu a existat un asemenea motiv.

Varianta pe care o propun e doar o sugestie, poate te ajută. Şi publicaţiile în limba engleză folosesc sintagma "subjective reasons" în contextul concedierii corecte, ca să zic aşa, de aceea nu sunt foarte sigură.

There are two types of termination: termination due to labour shortages, or termination due to personal reasons. Terminations are required to be well founded and reasonable according to the law. If a termination is done in conflict with the law the employer is liable for damages towards the employee.
